1. Introduction

These Membership Terms and Conditions ("Terms") govern the purchase, use and operation of all membership products offered by Caleb James Palmer (ABN 87 923 426 276) trading as SunZinc Australia ("SunZinc", "we", "our" or "us").
 

By purchasing, activating or using a SunZinc Membership, you acknowledge that you have read, understood and agreed to be legally bound by these Terms.

If you do not agree to these Terms, you must not purchase or use a SunZinc Membership.
 

These Terms operate together with our Privacy Policy, Competition Terms and Conditions and any other policies or conditions that apply to particular products, promotions or services offered by SunZinc.
 

Where an inconsistency exists between these Membership Terms and any Competition Terms relating to a particular promotion, the Competition Terms will prevail to the extent of that inconsistency.

 

2. Eligibility

Memberships are available only to individuals who are legally capable of entering into a binding contract under Australian law.
 

You must provide accurate and complete information when purchasing a membership.
 

You are responsible for ensuring that your contact information remains current so that we can communicate with you regarding your membership and any promotions or competitions you enter.

5. Membership Benefits

Membership benefits may include, depending on the membership purchased:

  • access to digital educational resources;

  • members-only pricing;

  • promotional competition entries;

  • exclusive member offers;

  • discounts on eligible products;

  • priority access to selected promotions;

  • and any additional benefits that SunZinc introduces from time to time.
     

Benefits have no cash value unless expressly stated otherwise.

Membership benefits must only be used in accordance with these Terms and any applicable promotion or offer.

 

6. Promotional Entries

Certain memberships include complimentary entries into eligible SunZinc promotions.
 

The number of entries allocated depends on the membership purchased and is displayed at the time of purchase.
 

Competition entries are automatically allocated once the purchase has been successfully completed.
 

Entries allocated through a membership remain valid for the applicable promotion even if the membership later expires or is cancelled, provided the entries were validly issued and have not been cancelled under the applicable Competition Terms and Conditions.
 

The allocation, use and validity of competition entries are otherwise governed by the Competition Terms and Conditions applicable to the relevant promotion.

 

7. Member Discounts

Eligible memberships include discounts on selected SunZinc products as advertised at the time of purchase.
 

Member discounts:

  • apply only to eligible products;

  • may be used together with promotional offers unless expressly stated otherwise;

  • cannot be redeemed for cash;

  • cannot be transferred to another person; and

  • may exclude selected products where specified by SunZinc.
     

SunZinc reserves the right to determine which products qualify for member discounts.

8. FAIR USE AND MONTHLY ALLOCATION CAPS
8.1 Commercial Purpose and Fair Use
All membership tiers are designed to provide genuine commercial value to our members through retail product discounts. To ensure equitable stock distribution, prevent commercial exploitation, and protect inventory levels, all product discounts are subject to strict monthly volume allocations ("Purchase Caps") as outlined in Section X.2.

8.2 Tiered Monthly Allocations
Members are entitled to apply their specific tier discount code to a maximum number of individual tins of zinc (including individual units contained within multi-packs) within any single calendar month cycle. Monthly allocations do not roll over to subsequent months. The limits are mandated as follows:

  • Standard Tier ($10/mo): Limited to a maximum of four (4) individual tins per calendar month.

  • Silver Tier ($25/mo): Limited to a maximum of eight (5) individual tins per calendar month.

  • Gold Tier ($75/mo): Limited to a maximum of fifteen (6) individual tins per calendar month.

  • Elite VIP Tier ($250/mo): Limited to a maximum of thirty (10) individual tins per calendar month.


8.3 Restrictions on Resale and Abuse
Discounts are strictly non-transferable and intended solely for the registered account holder's use (or authorized commercial use in the case of Elite VIP accounts). Any attempt to bypass these caps via multiple accounts, automated scripts, or fraudulent activity will result in immediate termination of the membership without a refund. We reserve the right to cancel any orders that breach or manipulate these Fair Use provisions.
 

9. Membership Period

Each membership remains active only for the period specified at the time of purchase.
 

Membership periods commence immediately upon successful purchase unless otherwise stated.
 

Once the applicable membership period expires, access to ongoing membership benefits will automatically end without notice.
 

Expiry of a membership does not invalidate competition entries that were properly issued during the membership period.

 

10. One-Time Purchase

All SunZinc memberships are sold as one-time purchases.

Memberships do not automatically renew.
 

No recurring payments or subscription charges will be applied unless you choose to purchase another membership.
 

Members may purchase additional memberships at any time.
 

Each membership purchase is treated as a separate transaction and receives its own associated benefits.
 

Where multiple memberships are held simultaneously, benefits will apply in accordance with the specific terms applicable to those memberships.

 

11. Payment

All membership fees are payable in Australian Dollars (AUD).
 

Payment must be successfully processed before a membership is activated and any associated benefits become available.
 

SunZinc may utilise third-party payment providers to process transactions. Payment information supplied during checkout is handled in accordance with the privacy policies and security practices of those providers.
 

If a payment is declined, reversed, charged back or otherwise cancelled, SunZinc may suspend or terminate the associated membership and cancel any benefits that have not already been validly used or awarded.

 

12. Cancellations

Members may cancel their membership at any time.
 

As SunZinc memberships are fixed-term, one-time purchases, cancellation simply ends the membership relationship and does not extend or shorten the original membership period.
 

Cancellation does not entitle a member to any refund, credit or partial reimbursement except where required by Australian law.
 

Membership benefits already received or used before cancellation cannot be reversed.
 

Competition entries validly allocated before cancellation remain governed by the applicable Competition Terms and Conditions.

 

13. Refund Policy

Except where required by the Australian Consumer Law or another applicable law, all membership purchases are final.
 

SunZinc does not provide refunds, exchanges or credits where:

  • a member changes their mind;

  • a membership is no longer wanted;

  • a membership expires without being fully used;

  • a member fails to use available benefits during the membership period; or

  • a member purchases the incorrect membership.
     

Nothing contained in these Terms excludes or limits any consumer guarantee or statutory right that cannot lawfully be excluded.

 

14. Changes to Memberships

SunZinc may modify, replace, remove or introduce membership benefits, pricing, inclusions or membership products from time to time as our business develops.
 

This may include changes to:

  • member discounts;

  • educational content;

  • promotional offers;

  • digital resources;

  • exclusive member benefits;

  • available membership tiers; and

  • future membership pricing.
     

Any changes will apply prospectively unless otherwise required by law.

Nothing in these Terms guarantees that any particular benefit will remain available indefinitely.

15. Member Responsibilities

SunZinc may immediately suspend or terminate a membership where we reasonably believe that a member has:

  • engaged in fraudulent, deceptive or unlawful conduct;

  • attempted to improperly obtain membership benefits;

  • interfered with the administration of our promotions;

  • initiated a payment chargeback without lawful grounds;

  • used abusive or threatening behaviour towards our staff; or

  • otherwise acted in a manner that may adversely affect SunZinc, other members or the integrity of our services.
     

Where reasonably practicable, we may notify the member of the reason for suspension or termination.
 

Termination of a membership does not affect rights or obligations that accrued before termination.

 

18. Multiple Memberships

A person may purchase more than one SunZinc Membership.

Each membership purchase is treated independently.
 

Benefits associated with each membership will be allocated separately unless expressly stated otherwise.
 

SunZinc reserves the right to determine how overlapping membership periods operate where multiple memberships are active simultaneously.

 

19. Non-Transferability

Memberships are issued solely to the purchaser.
 

Memberships cannot be assigned, transferred, gifted, sold, sublicensed or otherwise made available to another individual without the prior written consent of SunZinc.
 

Any attempted transfer contrary to this clause is void.

 

20. Intellectual Property

All intellectual property associated with SunZinc, including our branding, logos, website content, graphics, videos, educational material, digital resources, software and promotional content, remains the property of SunZinc or its licensors.

Purchasing a membership does not transfer ownership of any intellectual property.
 

Members receive only a limited, non-exclusive, non-transferable licence to access membership content for their personal, non-commercial use.

21. Availability of Services

31. Governing Law

These Membership Terms are governed by the laws of Queensland, Australia.

Each member irrevocably submits to the exclusive jurisdiction of the courts of Queensland in relation to any dispute arising from or connected with these Terms.

23. Definitions

Unless the context otherwise requires:

  • you acknowledge that exposure to ultraviolet radiation carries inherent risks;

  • you accept responsibility for continuing to adopt recognised sun-safe practices, including seeking shade, wearing protective clothing, wearing a hat and sunglasses where appropriate, and limiting exposure during periods of high UV; and

  • you acknowledge that individual outcomes will vary depending on factors including product application, skin type, environmental conditions and duration of sun exposure.

     

32. Interpretation

In these Store Terms:

  • headings are included for convenience only and do not affect interpretation;

  • the singular includes the plural and vice versa where the context permits;

  • references to legislation include any amendment, replacement or re-enactment of that legislation;

  • a reference to "including" or similar expressions means "including without limitation"; and

  • if any ambiguity exists, these Terms will not be construed against a party merely because that party prepared them.
     

33. Survival

Any provision of these Store Terms that, by its nature, is intended to survive termination or completion of an order will continue in force after the relevant order has been completed.

Refund Policy

1. Overview

At SunZinc Australia, we are committed to supplying high-quality products.

Because our products include skincare and personal care items, we generally do not accept returns or provide refunds unless required under the Australian Consumer Law.
 

By purchasing from SunZinc Australia, you acknowledge that this Policy forms part of the terms applying to your purchase.

 

2. Change of Mind

SunZinc Australia does not provide refunds, exchanges or store credit where you:

  • change your mind;

3. Opened and Used Products

For hygiene, safety and quality assurance reasons, opened, used or tampered products cannot be returned unless required under the Australian Consumer Law.

  • photographs of the product;

  • photographs of the packaging;

  • the order number;

  • details of the issue; and

Failure to provide requested information may delay assessment of your request.

 

8. Product Assessment

Before providing a refund, replacement or other remedy, SunZinc Australia may require the product to be returned for inspection.
 

No refund, replacement or other remedy will be provided until the returned product has been assessed, except where otherwise required by law.
 

Where inspection confirms that the product does not qualify for a remedy under the Australian Consumer Law, the product may be returned to you at your expense.
